Tilted Gaming - Mobile App Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Tilted Gaming mobile application (the "App") operated by Tilted Gaming ("we," "us," or "our").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts we believe belong to users under 13.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at tiltedgamingtcg@gmail.com if you become aware of any unauthorized use of your account.

You may not create an account on behalf of another person or use another person's account without their permission.

3. User Conduct

You agree not to use the App to:

  • Post, send, or share content that is harassing, threatening, abusive, hateful, obscene, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Submit false or fraudulent score submissions or match results
  • Attempt to manipulate leaderboards or competitive standings through deceptive means
  • Attempt to gain unauthorized access to any part of the App or its infrastructure
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Spam or send unsolicited messages to other users
  • Collect or harvest other users' personal information

We reserve the right to remove any content and terminate any account that violates these Terms, at our sole discretion and without prior notice.

4. User-Generated Content

The App allows you to submit content including messages, profile information, score submissions, and reports ("User Content"). You retain ownership of your User Content but grant Tilted Gaming a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content as necessary to operate the App.

You represent and warrant that your User Content does not violate any third-party rights and complies with these Terms.

We are not responsible for User Content submitted by other users. If you encounter content that violates these Terms, please use the in-app reporting tools or contact us at tiltedgamingtcg@gmail.com.

5. Score Submissions and Leaderboards

Score submissions are subject to staff review and approval. We reserve the right to approve, deny, or remove any score submission at our sole discretion. Submitting false, manipulated, or fraudulent scores is a violation of these Terms and may result in permanent account termination.

Leaderboard standings are determined by approved score submissions. We do not guarantee the accuracy of leaderboard data and reserve the right to make corrections at any time.

6. VIP Program and Events

Participation in VIP events and programs is subject to availability and additional terms communicated at the time of registration. VIP status is non-transferable. We reserve the right to revoke VIP status for violations of these Terms.

7. Push Notifications

By using the App, you consent to receive push notifications related to your account activity, including friend requests, messages, score reviews, event updates, and promotions. You may opt out of promotional notifications through your in-app notification settings or your device's operating system settings.

8. Intellectual Property

The App and its original content, features, and functionality are owned by Tilted Gaming and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may delete your account at any time by contacting us at tiltedgamingtcg@gmail.com. Upon termination, your right to use the App ceases immediately.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TILTED GAMING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED $100 USD.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
